OHIO Authorizes: Marijuana for Recreational Use
An FYI for Ohio Employers Upon The Approval of Recreational Use of Marijuana
On 11/7/2023, voters of Ohio approved the legalization of using Marijuana for recreational purposes through ballot proposals and making Ohio the 24th State in the United States to permit the use of recreational use except for medical purposes.
With this big news, There are a lot of questions surrounding what an employer can and cannot do.
Employers’ Rights
The legalization states “Rights of Employer” according to Section 3780.35 of the law, and here are some basic points:
- Employers do NOT have to accommodate employee’s cannabis use
- You CAN refuse work applications.
- You CAN have Zero-tolerance policies
- Employees CANNOT take legal action against employers for infractions due to the use of cannabis.
